Terms and Conditions for Operating Cairo Amman Bank Cards on Apple Pay

These terms and conditions govern the use of cards issued by Cairo Amman Bank with the Digital Wallet (“Wallet”) enabled on compatible devices of the customer from time to time.

These terms of use constitute a binding legal agreement between the customer and Cairo Amman Bank.

They are applied to the customer and/or any other person authorized by the customer to use the wallet system cards.

The customer must carefully review the terms of use before adding or using any card in the wallet system, and while doing that, the customer agrees to be bound by the terms of use.

The terms of use are read with the terms and conditions of the mobile banking services, the terms and conditions of the online banking services, the account services, the terms and conditions of the Cairo Amman Bank cards operation feature on Apple Pay, and the terms and conditions of the credit card.

In the event of any conflict or inconsistency between these terms and conditions and terms of use in connection, these terms shall prevail.

  1. Card: A credit, debit, or prepaid card issued by Cairo Amman Bank to the customer that is not expired, blocked, suspended, or canceled.
  2. Customer: A holder of the bank account related to the Cairo Amman Bank card or the holder of a card account issued by Cairo Amman Bank.
  3. Device: Includes but is not limited to a smartphone, tablet, smartwatch, or any other device compatible with the wallet system, which Cairo Amman Bank determines to be eligible to register Cairo Amman Bank cards to be used in the wallet system.
  4. Wallet: The mobile payment and digital wallet service created by third-party wallet providers that enable users to make payments using certain devices and cards registered on such devices.
  5. Passcode: The secret code required to unlock a device, including a password, passcode, pattern, or biometric identifier (as the case required).

The customer can add their Cairo Amman Bank card(s) to the wallet by following the instructions of the wallet provider. Only Cairo Amman Bank cards specified by the bank are eligible to be added to the wallet. If the card or account is not performing well, the card will not be eligible for wallet registration. When a card is added to the wallet, the wallet will allow the customer to use the card to make transactions at locations where the wallet is acceptable. The wallet may not be accepted in all places that accept Cairo Amman Bank cards.

The customer shall contact the wallet provider to know how to remove their card from the wallet. Cairo Amman Bank can also block the card in the wallet at any time based on the customer’s request.

  1. Cairo Amman Bank will not be liable for any loss that the customer incurs by using the wallet system unless the direct cause is gross negligence and/or willful misconduct by the bank.
  2. In the event of fraud, loss, or theft of the device, the customer is obligated to immediately report such loss or theft to the bank, in addition to other parties such as the telecommunications service provider and others. Based on that notification, the bank will arrange to stop all card-wallet transactions. However, the customer will be able to continue using the regular plastic card for all registered cards. The customer hereby indemnifies the bank for any claims, costs, fees, or losses incurred in connection with any transactions affected by the use of the customer’s device before the customer informs the bank of the fraud, loss, or theft or requests the bank to stop the card.
  3. The bank reserves the right, at its sole discretion, to refuse to authorize any transaction if it suspects a breach of the terms of use or fraudulent or illegal activity has occurred.
  4. When adding a card to the wallet system, the bank collects certain information from the customer to verify the customer’s identity in order to enable the customer to use the card and facilitate the subscription to the wallet.
  5. The bank also requests certain account information relating to each card the customer chooses to use with the wallet system, including the latest transaction data, but not the entire card account number. The customer hereby agrees that the bank may periodically collect and use technical data and related information, including, but not limited to, technical information about the customer’s device, to facilitate updates of the services. The bank may use this information to improve its products or provide services or technologies as long as they do not personally identify the customer.
  6. The customer may receive notifications from the wallet system indicating card account activity. If the customer does not want to receive notifications, they can turn them off within the device notification settings or the wallet application settings.
  7. The customer shall cooperate with the bank in any investigations and work to use any procedures related to anti-fraud or otherwise as provided by the bank.
  8. The customer is solely responsible for protecting their cards, wallet transactions, and any other information on their device in the event of losing or selling the device to any other party or person.
  9. In the event of a breach of the device’s confidentiality or passcode, the customer shall be fully and solely responsible and bear all fees, costs, losses, and damages arising from such breach. In the event that the customer discloses the passcode intentionally or unintentionally, they shall indemnify the bank for any unauthorized payment, fees, costs, or losses and any transaction affected by such breach.
  10. If the customer has any queries, disputes, or complaints about the wallet, they ought to contact the wallet service provider using the information provided to them by the supplier. If the customer has any questions, disputes, or complaints about the card, they can contact the bank immediately using the number printed on the back of the card.

The passcode is considered a signature and acknowledgment by the customer of their approval to subscribe, enter, and/or agree to implement any requests, services, or transfer orders. It doesn’t accept any claim that the passcode has been published and used by another party or the claim that the customer did not request any of the available services.

Cairo Amman Bank has the right to terminate and change these terms of use or add or delete any of the clauses in these terms of use at any time. The applicant cannot change these terms, but these terms of use enable them to remove all cards from the wallet at any time.

The customer accepts and understands that it is their responsibility to understand and read the bank’s website’s updated terms of service. They are not entitled to file any claim against the bank due to the failure to send them a notice or to agree to the changes made to the terms of use by the bank. The bank has the right to make these amendments occasionally without the need to obtain the customer’s consent.

Cairo Amman Bank is not the wallet provider and is not responsible for providing the wallet service to the authorized person. The bank is only responsible for providing the information securely to the wallet provider to enable the card to be used in the wallet. The bank is not responsible for any wallet failure or inability to use the wallet for any transaction. It is not responsible for the performance or nonperformance of the wallet provider or any other parties regarding any agreement they enter into with the wallet service provider or related third-party relationships that may affect the use of the wallet and will not be liable to the customer for such failure or the performance of the wallet provider.

The customer agrees to receive emails and notifications from Cairo Amman Bank regarding their cards and wallet. The customer agrees that Cairo Amman Bank can contact the customer by email, SMS, or mobile phone registered on their account. It may include contact addresses of companies that do business on their behalf to service accounts. The customer undertakes and pledges to update their contact information registered with the bank as soon as they change, and the bank does not bear any responsibility resulting from the customer’s failure to update the information and inform the bank thereof.

The card’s virtual presentation is authorized for use by the customer only in accordance with the terms of use. The bank reserves all rights of third parties expressly granted to the authorized person.

The customer is granted a non-exclusive, non-sublicensable, non-transferable, personal, and specific license to install and use codes and other credential information associated with the card to make payments with the device only in accordance with the terms of use. The license is limited to use on any device they own or control as authorized under any applicable third-party agreements.

The customer shall not rent, lease, lend, sell, redistribute, or sublicense any right to use any card credentials in the wallet system.

The customer hereby agrees that the virtual representation of the card in the clearing system or the credential information may be updated or improved without notice. The bank may, at any time, at its sole discretion, and without prior notice, expand, reduce, or suspend the card or any commission transactions allowed using the card with the wallet system.

These terms of use are only between the bank and the customer. Third-party services, including the wireless carrier and other applications or websites integrated into the wallet system, may have their own third-party agreements. Customers may be subject to such third-party agreements when they provide such third parties with personal information in order to use their services, visit their applications or websites, or otherwise be governed by the current circumstances. The bank shall not be liable for the security, accuracy, correctness, suitability, or any other elements of the content or functionality of the products or services of any third party. It is the customer’s responsibility to read and understand any third-party agreements before adding or using the card through the wallet system.

The terms and account agreement governing the customer’s card do not change when added to the wallet. The customer wallet provides another way to make purchases using the card. Any interest, fees, or charges applicable to the customer’s card will also be applicable when they use the wallet to access their card. The wallet service provider and other third parties, such as wireless carriers or data service providers, may charge fees as specified by the bank, and the customer shall bear such fees without any bank liability.

Cairo Amman Bank will not be responsible for and does not provide any support or assistance for any third-party device, software, products, or other services. Suppose there are any matters or questions regarding a third-party product or service, including matters related to the operation of the device. In that case, the customer shall contact the third party in accordance with their procedures for customer support and assistance.

These terms and provisions shall be governed by the laws of the Hashemite Kingdom of Jordan and subject to the jurisdiction of the competent Palace of Justice – Amman Court. Notwithstanding the foregoing, the bank may choose the court, whether inside or outside Jordan, at its sole discretion and determination to consider any dispute arising out of or related to the interpretation or application of these terms and conditions or the use of the service in accordance with the laws and legislations in Jordan.  The customer waives their right to exchange judiciary notifications.

  1. The customer shall be solely responsible for maintaining the security and safety of the device, the confidentiality of locking the device, PIN code, passcode, other means of accessing the wallet, card credentials, or any personal or other payment information regarding the device when sharing the device and/or means of access with any person, who may be able to use the cards and access to personal and payment information available in the wallet system. The customer must maintain the security and integrity of the device and personally identifiable data with the same keenness to protect their cash, checks, debit or credit cards, and other PINs and passwords.
  2. The terms and account agreement governing the customer’s card does not change when it is added to the wallet. The customer’s wallet provides another way to purchase using the card. Any interest, fees, or charges applicable to the customer’s card will also be applicable when they use the wallet to access their card. The wallet service provider and other third parties, such as wireless carriers or data service providers, may charge fees as specified by them, and the customer shall bear such fees without any bank liability.
